It is acknowledged that in the past certain companies within the AMEC group used the services of the Consulting Association, and that the records of the Consulting Association included information in relation to the following individuals:

  1. John Barry
  2. Roy Bleasdale
  3. Michael Briggs
  4. Gary Caffrey
  5. Michael Conway
  6. David Isherwood
  7. Richard Keane
  8. Kelvin McKeown
  9. Nigel McKeown
  10. Michael Wharton
  11. Peter Robin Wharton

("the Individuals")

In addition, information about the Individuals was provided to or received from Mr Kerr by companies within the AMEC group.

The AMEC company further acknowledges that on 2 March 2009 the Information Commissioner's Office served an enforcement notice on Mr Kerr as data controller, relating to information that he held about various individuals. As a result, Mr Kerr pleaded guilty to a breach of section 17 of the Data Protection Act 1998, and was convicted on 16 July 2009 at Knutsford Crown Court.

The AMEC company wishes to express its regret for its involvement with the activities of the Consulting Association and of Mr Kerr. It is sorry that information was held about the Individuals by the Consulting Association, and it regrets any loss or hardship that they may have suffered, either in their employment prospects or personal and family life, as a result.

For the avoidance of doubt, the AMEC company does not admit that it has acted unlawfully in relation either to the Individuals or to any other person affected by the activities of Mr Kerr or the Consulting Association.

AMEC is committed to the importance of ensuring equal opportunities, free from bias or discrimination and has policies and procedures in place to prevent discrimination of any sort."
